Авторами исследуется понятие постпенитенциарного контроля за лицами, освобожденными от отбывания наказания в виде лишения свободы в связи с болезнью, как разновидности государственного контроля. Рассмотрен ряд основных функций, характерных для контроля за освобожденными в момент их фактического убытия из исправительного учреждения. Анализ мнений ученых относительно сходства и различия понятий государственного и постпенитенциарного контроля позволил авторам выделить специальные признаки контроля за лицами, освобожденными от наказания в связи с болезнью, определить его цели, а также сформулировать доктринальное определение данного правового явления.
The authors explore the concept of post-penitentiary control over persons released from serving sentences of imprisonment due to illness, as a type of state control. A number of basic functions characteristic of monitoring released persons at the time of their actual departure from the correctional institution are considered. The analysis of scientists’ opinions on the similarities and differences between the concepts of state and post-penitentiary control allowed the authors to identify special signs of control over persons released from punishment due to illness, determine its goals, and formulate a doctrinal definition of this legal phenomenon.
