Abstract (English):
The object of the research in the article is the penal policy conducted in Kazakhstan and the Russian Federation, the subject is the state bodies’ activity concerning the development and establishment of penal policy. The main factors influencing the penal policy of Kazakhstan and the Russian Federation are considered. The modern direction of penal policy as a wider use of punishment without isolation of a convict from society is proved. The modern penal policy of Kazakhstan and Russia is aimed at achieving three main goals: correction of convicts, crime prevention, social adaptation and rehabilitation of convicts. The features of the legal institution “probation” application are revealed, and the measures for its improvement are proposed.
