REASONS FOR INITIATING PROCEEDINGS ON EARLY RELEASE FROM SERVING A SENTENCE: SOME THEORETICAL AND LEGAL PROBLEMS

Abstract (English):
The article examines the problems of legal regulation of the petition of the convicted person, his lawyer and legal representative, as well as the presentation of the administration of the institution or body executing the punishment, as a reason for initiating proceedings on parole from serving the sentence, replacing the unserved part of the punishment with a milder type of punishment and release from punishment due to illness. The main focus is on penal and criminal procedure legislation. The authors have identified gaps in the regulation of individual issues in the field under study.
